Previous FBI head James the former director has pleaded not guilty to providing misleading information to lawmakers and impeding a lawmaking procedure.
The former director's lawyer submitted the plea on his behalf in a national courtroom in Alexandria, Virginia on Wednesday.
Patrick Fitzgerald announced he would seek to have the legal matter terminated for several factors including that his client, a detractor of President Donald Trump, was being targeted.
James Comey was charged shortly after the former president urged his chief prosecutor to take action against him.
During the hearing on Wednesday, Comey's lawyer the legal representative informed the magistrate they aimed to present several motions to terminate the legal matter before a legal hearing, stating the prosecution was retaliatory and that a government lawyer was unlawfully appointed to take over the case.
The former director's case was first overseen by the original attorney, who stepped down under influence from the former president after his probe into an additional political adversary - New York Attorney General Letitia James - did not succeed to file indictments.
James Comey appeared in positive mood as he entered the legal venue on Wednesday, conversing with his lawyers and sharing humor. He was joined by his spouse, Patrice Failor and offspring his daughter, a US lawyer who the previous administration dismissed.
Upon hearing to the magistrate read his legal protections and the pair of allegations against him in court on Wednesday, Mr Comey was asked if he understood the charges.
"I do your honour. Thank you," he told the proceedings.
James Comey was the chief of the Federal Bureau of Investigation from four years and was dismissed about several months into Donald Trump's initial presidency as national leader. At the period, he was overseeing an investigation into international campaign influence and whether there were any relationships between Russia and the presidential campaign.
During his tenure, Mr Comey caused a negative reaction from the Democratic party when he stated just shortly prior to the national vote that he was investigating Democratic candidate the candidate's use of a non-governmental email account. Charges against Clinton were not pursued, causing disapproval from the Republican party as well.
The federal government claim James Comey provided false information to US lawmakers during a Senate Judiciary Committee hearing in 2020 when he was being questioned about both the email probe as well as the election interference investigation. They claim he provided false information to the legislative body by claiming he had not approved someone at the FBI to disclose to journalistic entities details about the government examinations.
Prosecutors also allege the defendant of "improperly attempting to sway, block and delay" the panel by making false statements to it.
Via social media the former director published to his Instagram after he was indicted, he stated he was not guilty and accused Trump of conducting himself like a "dictator".
"We have understood for considerable time that there are consequences to challenging Mr Trump," he stated. "We choose not to live on our kneeling."
"I'm innocent," he stated further. "Thus initiate a legal proceeding."
The charges against the former director emerged after Trump shared on digital channels calling for his attorney general, Pam Bondi, charge the former director and others.
